Our contract states that any hours worked after 8 continous hours in a workday is to be paid at the rate of time and a half ie. overtime. Well, a few months ago I was working a special shift. It started normally at 8:00 P.M. and ended about 6:00 A.M. the next day. I kept track of my hours and when my check came it was wrong. The total hours was right but the division between regular and overtime was wrong. I talked to payroll and they proceeded to show me how they clocked me out at 11:59 and then back in at 12:00 thus resetting my total time on the clock. I spoke with the V.P. and he said they were figuring it wrong and that he would talk to the boss about getting my money. Long story short, the company is refusing to pay and they are saying that a workday is from midnight to midnight. The union and I say that the workday begins when I clock in and ends when I clock out. I've had several meetings with them over this issue. Our union rep has even sat with them. I was told that it was settled when he came down to talk with them. Today we had yet another meeting, and again they are refusing to pay. I really blew up and gave them a piece of my mind. These people are idiots and thieves. They are going to push this thing all the way to arbitration and spend a sh@t load of money all over $20. And they wonder why people go postal!

The union and I say that the workday begins when I clock in and ends when I clock out. And so does the department of labor. I've dealt with similar petty situations where the company is trying to save a buck or two. Whats worse is if the decision goes in the company's favor, than it allows them to continue to do it in the future. This may add up to big bucks for them. If the union can't do anything for you, than contact the department of labor. Also, most every company's insurance does not cover you operating their equipment off the clock. I could think of many ways to manipulate that into forms of leverage.

JOE,
JUST READ YOUR POST ABOUT THIS OVERTIME DEAL, AND IT SOUNDS AS THOUGH ITS TO BIG OF A HEADACHE FOR THE LITTLE MONEY INVOLVED. I KNOW THE POINT IS THEY SHOULD PAY YOU, AND MATT HAS THE RIGHT IDEA ON CALLING LABOR RELATIONS. YOU ALSO CAN GET IT BACK WITH INTEREST AT THE END OF EVERYDAY TAKE AN EXTRA 15 MINUTES TO WASHOUT. I KNOW THIS IS NOT THE RIGHT WAY TO GO ABOUT GETTING MONEY THATS OWED TO YOU, BUT SOUNDS LIKE ITS THE ONLY WAY ITS GOING TO HAPPEN.

UPDATE! Well, we had a mediator come in and he pretty much told the company that they were screwing up. I know it seems petty, and believe me I know how to get it back , but I found out that they have been doing it like this since 2002. Twenty bucks was one man for one week. Imagine thirty drivers over 5 years. If I had let that continue I wouldn't have been able to sleep. What really ticked me off though wasn't the refusal to pay. It was two things: 1). I was told three times that they were going to pay, and three times they changed their mind. 2). The fact that they tried to use double speak to placate me like I was some kind of idiot. Plus I was right and they were wrong and I loved letting them know that. As far as the DOL is concerned, I called them and they agreed with me, but they said that since I filed a grievance they couldn't do anything. Something about using outside counsel. I would have to get someone else to file.

I am so depressed! I really thought that the union was a real step up in my carrier as a mixer driver better pay better benefits right? Wrong!! This having to work 18 days a month and if you don't you pay a pro-rated amount has forced me and my family to go with no benefits for 2 months because the union health and wealfare wants almost $1900.00 in payments to continue my health care benefits. How can I afford this if we are not working due to winter cold,rain, and the very slow building of new homes. I am now having to use vacation days so I don't have to go 3 months with no insurance. I am not the only one in our company who feels the union has sold us out! Some of our men have already went and found other jobs while we try to hold on. Here in New Jersey there is just to many companys and not enough work I was proud and still am to be a teamster but I am not sure how much longer my coworkers and I can hold on!! If anyone has any sugestions on who we can go to about this please help cause our local and business agents are doing nothing to help. When our contract was signed the amount of days was 15 than we were told after a couple months that it was going to be changed to 18 those 3 extra days were a killer! We are effected by the weather more than any truck driver in the teamsters if it rains UPS, Frieght delivery etc still work we do not What can we do!!!

Times are tough for a lot of people right now. Things are no better in Michigan. I've witness’s similar situations over the last 6-8 months. I wouldn't be so quick to point the finger at the union though. They are there to try and provide you with the best when your working, but they have no control over the work load. There is not much they can do to generate more work. I would be quicker to point the finger at government officials and the economy. A contract is a contract. Nobody should be able to change it?? The weather variable is just something you except when you join this line of work. I would suggest looking into other Teamster jobs if your dead set on retiring through them. Otherwise, a new line of work may be in order. The word around here is that things are going to get worse before they get better. Hope this isn't the case for you.

Matt its tuff I love my job and its great going to work doing something you enjoy instead of going in every morning hating what you do. I know its not the unions fault Sometimes I just need to vent and I feel like other mixer drivers can understand how I feel. I have a 14 year old son and I sure hope things get better not only for me but for his future also!!!!!
